Terms & Conditions

Last updated: October 17, 2026

This page covers two separate things. The text messaging terms apply to anyone who gives us a mobile number, whether or not they ever become a client. The services terms below them apply to paid engagements and accompany the proposal and invoice for that work.

Text messaging

Home Service Engine sends text messages to people who give us their mobile number through a form on this site, or who give it to us directly in the course of a conversation.

What we send — One-to-one conversational messages from a member of our team: replying to your enquiry, arranging a call, confirming an appointment, or following up on a conversation already underway. We do not send automated marketing broadcasts or promotional campaigns by text.

How you opt in — Providing your mobile number on a form on this site, where that form states we may text you, is your consent to receive these messages. The phone field is optional on every form we run. You can reach us without giving us a number.

Message frequency — Varies. These are real conversations, so the count depends on the exchange. Typically a handful of messages around an active enquiry, and none at all when there is nothing to discuss.

Cost — Message and data rates may apply. We do not charge for text messages; your mobile carrier may.

Opting out — Reply STOP to any message and we will stop texting you. You will receive one confirmation that the opt-out took effect, and nothing after that. Opting out of texts does not remove you from email or stop us returning a phone call. Email hello@homeserviceengine.co if you would like us to stop contacting you entirely.

Help — Reply HELP to any message, email hello@homeserviceengine.co, or call 404-282-2730.

Carriers — Mobile carriers are not liable for delayed or undelivered messages.

Your number — We do not share or sell mobile numbers or SMS consent to third parties for marketing. See our Privacy Policy for how we handle your information.

Services terms and conditions

By accepting and paying this invoice you are agreeing to the terms and conditions below. If you do not agree to these terms and conditions you should not proceed with this purchase.

These Services Terms and Conditions (“Terms”) pertain to the services (“Services”) to be provided by Home Service Engine (“HSE”) to the customer (“Customer”) listed on the proposal (“Proposal”) to which these Terms are attached. By agreeing to the Proposal, paying the invoiced Fees and/or receiving the Services, Customer is agreeing to these Terms.

1. Performance of Services. HSE will perform the services set forth on the Proposal in compliance with all requirements set forth therein. HSE will provide reasonable support pertaining to any bugs, errors or other issues pertaining to the Services. Customer will provide assistance as requested by HSE as necessary to perform such support services.

2. Fees. Customer will pay HSE the fees set forth in the Proposal (“Fees”), on the terms and in the manner set forth in the Proposal. Unless otherwise specified in the Proposal, Customer will not reimburse HSE for any expenses incurred by HSE in connection with performing Services and any expenses incurred by HSE in performing the Services will be the sole responsibility of HSE.

3. Relationship.

3A. Independent Contractor. HSE is an independent contractor and nothing in these Terms will be construed as establishing an employment or agency relationship between HSE and Customer. HSE has no authority to bind Customer by contract or otherwise. HSE will perform Services under the general direction of Customer, but HSE will determine, in HSE’s sole discretion, the manner and means by which Services are accomplished.

3B. Taxes and Employee Benefits. HSE will be solely responsible for the payment of all withholding taxes, social security, workers’ compensation, unemployment and disability insurance or similar items required by any government agency. HSE will not be entitled to any benefits paid or made available by Customer to its employees, including, without limitation, any vacation or illness payments, or to participate in any plans, arrangements or distributions made by Customer pertaining to any bonus, stock option, profit sharing, insurance or similar benefits.

4. Intellectual Property Rights.

4A. Definitions.

4Ai. “HSE IP Rights” means all IP Rights developed, owned or obtained by HSE prior to, during or after the engagement under this Agreement.

4Aii. “IP Rights” means all worldwide patent rights (including patent applications and disclosures), copyright rights, mask work rights, trade secret rights, know-how, and any and all other intellectual property or proprietary rights.

4B. Rights. HSE will retain all ownership to all IP Rights in and to the Services and all HSE IP Rights.

5. Confidentiality. For purposes of this Agreement, “Confidential Information” means and will include any information, materials or knowledge regarding Customer and its business, financial condition, products, programming techniques, customers, suppliers, technology or research and development that is disclosed to HSE or to which HSE has access in connection with performing Services. Confidential Information will not include any information that: (a) is or becomes part of the public domain through no fault of HSE; (b) was rightfully in HSE’s possession at the time of disclosure, without restriction as to use or disclosure; or (c) HSE rightfully receives from a third party who has the right to disclose it and who provides it without restriction as to use or disclosure. At all times, both during HSE’s engagement by Customer as an independent contractor and after its termination, and to the fullest extent permitted by law, HSE agrees to hold all Confidential Information in strict confidence, not to use it in any way, commercially or otherwise, except in performing Services, and not to disclose it to others.

6. Warranty and Disclaimer. HSE represents and warrants that the Services will be performed in a professional manner, consistent with professional and industry standards by individuals with the requisite training, background, experience, technical knowledge and skills to perform the Services. EXCEPT FOR THE FOREGOING EXPRESS WARRANTIES, ALL OTHER WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, ACCURACY, NON-INFRINGEMENT, TITLE, MERCHANTABILITY, AND THOSE THAT MAY ARISE FROM ANY COURSE OF DEALING OR PERFORMANCE, ARE HEREBY DISCLAIMED. HSE takes no responsibility for the functionality of the underlying software and/or service provided to Customer by the manufacturer.

7. Term and Termination. These Terms will commence on the Effective Date of the Proposal and, unless terminated earlier in accordance with the terms of this Agreement, will remain in force and effect for as long as HSE is performing Services pursuant to the Proposal. Either party may terminate these Terms if the other party breaches any material term of these Terms and fails to cure such breach within thirty (30) days following written notice thereof from the non-breaching party.

8. Limitations. IN NO EVENT WILL EITHER PARTY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH THIS AGREEMENT, EVEN IF CUSTOMER HAS BEEN INFORMED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES. HSE’S AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS AND THE SERVICES SHALL NOT EXCEED THE AMOUNTS PAID TO HSE DURING THE PREVIOUS TWELVE (12) MONTH PERIOD.

9. General. Neither party may assign or transfer any of its rights or delegate any of its obligations under this Agreement, in whole or in part, without the other party’s express prior written consent except in the acquisition of the assigning party by way of sale of stock sale of assets, merger or similar means. Any attempted assignment, transfer or delegation, without such consent, will be void. These Terms will be governed by and construed in accordance with the laws of the State of Delaware, excluding that body of law pertaining to conflict of laws. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in the Delaware and the parties hereby irrevocably consent to the personal jurisdiction and venue therein. If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of the Agreement will remain in full force and effect, and the provision affected will be construed so as to be enforceable to the maximum extent permissible by law. This Agreement, together with the Proposal, constitutes the complete and exclusive understanding and agreement of the parties with respect to the subject matter hereof and supersedes all prior understandings and agreements, whether written or oral, with respect to the subject matter hereof. Any waiver, modification or amendment of any provision of these Terms will be effective only if in writing and signed by the parties hereto. The waiver of any breach of any provision of these Terms will not constitute a waiver of any subsequent breach of the same other provisions hereof.
